Green Yurts Ltd. – Terms and Conditions of Sale

Please read these Terms and Conditions of Sale (“Terms”) carefully before placing an order with Green Yurts Ltd. (“we”, “us”, “our”). By purchasing any products (including yurts and accessories) via our website www.greenyurts.co.uk (the “Site”), by phone, or by email, you agree to be bound by these Terms. If you do not agree to these Terms, you must not place an order.

1. Definitions In these Terms:

• “Yurt(s)” means any tent, yurt, structure, kit, or related product supplied by us.

• “You” / “Customer” means the person or business purchasing from us.

• “Contract” means the legally binding agreement between you and us for the sale and purchase of Products under these Terms.

• “Products” means yurts, accessories, and any other goods listed on the Site or in our quotations.

2. Orders and Formation of Contract

• 2.1. All orders are subject to availability and our acceptance.

• 2.2. Placing an order on the Site, by phone, or by email is an offer to purchase Products in accordance with these Terms.

• 2.3. The Contract is formed only when we send you an order confirmation (by email or other written form) accepting your order.

• 2.4. We reserve the right to refuse any order, for example due to stock issues, pricing or description errors, or concerns about misuse or resale.

3. Product Information

• 3.1. We make reasonable efforts to ensure that descriptions, dimensions, images, and specifications of the Products are accurate. However, minor variations (for example in colour, stitching, or natural materials like wood or canvas) may occur.

• 3.2. Yurts and tents are semi-permanent / temporary structures and may not be suitable for all locations, weather conditions, or uses. It is your responsibility to check suitability for your intended purpose.

• 3.3. Any advice or recommendations provided by us are for general guidance only and should not be relied upon as a substitute for professional advice (e.g. structural, planning, or legal advice).

• 3.4. Approximate Measurements: All measurements, dimensions, and sizing information provided on our Site, in marketing materials, or verbally/in writing by our sales team are strictly approximate. Due to the bespoke, handmade, and flexible nature of our Products, exact dimensions will vary.

4. Pricing and Taxes

• 4.1. Prices are stated in British Pounds (£) and, unless clearly stated otherwise, include any applicable taxes (e.g. VAT/sales tax).

• 4.2. Delivery, installation, and additional services may be charged separately and will be shown before you confirm your order where possible.

• 4.3. We may change prices at any time, but such changes will not affect orders we have already accepted.

• 4.4. In the event of an obvious pricing error, we are not obliged to supply the Products at the incorrect price and may cancel the order and refund you in full.

5. Payment Terms

• 5.1. Payment methods accepted are specified on the Site and may include card/payment provider/bank transfer.

• 5.2. Unless otherwise agreed in writing, full payment is due at the time of order.

• 5.3. For made-to-order or custom yurts, we may require a non-refundable deposit of 50% with the balance payable before dispatch or installation.

• 5.4. We are not obliged to dispatch any Products until full cleared payment has been received.

6. Delivery & Risk

• 6.1. Estimated delivery times will be provided at checkout or in your order confirmation but are estimates only. Time of delivery is not of the essence.

• 6.2. Delivery will be made to the address you provide. You must ensure that access is reasonable for delivery vehicles and that someone is available to accept and sign for the Products where required.

• 6.3. Risk in the Products passes to you when they are delivered to the address provided (or collected by you or your courier).

• 6.4. Title (ownership) of the Products passes to you only when we have received payment in full for all sums due in respect of the Products.

• 6.5. If you fail to take delivery on the agreed date, we may charge you reasonable storage and re-delivery costs.

7. Site Preparation, Platforms, and Installation

• 7.1. You are responsible for ensuring that the site is suitable, safe, and adequately prepared for the yurt, including level ground and drainage.

• 7.2. Underground Services: Where Green Yurts Ltd. is contracted to build decking, platforms, or any structure requiring ground penetration (including but not limited to digging footings or installing ground screws), the Customer is solely responsible for ensuring the build location is free from underground services. This includes electricity, gas, drainage, water, telecommunications, or any other subterranean utilities.

• 7.3. Green Yurts Ltd. accepts no responsibility or liability for damage caused to underground services while working in the area specified by the Customer.

• 7.4. The cost of any remedial works required to repair damage to underground services, foundations, drainage systems, or buried artefacts shall be the sole responsibility of the Customer.

• 7.5. If installation cannot proceed or is delayed due to an unsuitable or unsafe site, additional charges may apply.

• 7.6. Pre-Delivery Construction by Customer: If you choose to independently construct a platform, decking, entrance-way, or any other supporting structure for the yurt prior to its physical delivery, you do so entirely at your own risk. Because all provided measurements are approximate (as detailed in clause 3.4), we strongly advise waiting until the yurt has been delivered so that exact physical measurements can be taken before finalizing any structural dimensions or frameworks.

• 7.7. Green Yurts Ltd. accepts no liability or responsibility for any financial costs, materials, labour, or delays required to alter, adjust, or rebuild supporting structures that were constructed to incorrect dimensions based on our approximate measurements.

8. Permits, Planning, and Local Regulations

• 8.1. You are solely responsible for obtaining any required planning permission, building permits, landlord consent, or other approvals necessary to erect and use the yurt at your chosen site.

• 8.2. We do not guarantee that the yurt will comply with any specific local regulations, zoning, or building codes.

• 8.3. We accept no liability for losses arising from your failure to obtain necessary approvals.

• 8.4. Third-Party Disputes: We accept no liability for losses or disruptions arising from issues with neighbours, landlords, or local authorities (such as the refusal of planning permission or enforcement actions). Such issues do not constitute grounds for a refund or cancellation of the Contract.

9. Inspection on Delivery

• 9.1. You must inspect the Products on delivery and notify us of any visible damage or errors within 1 day of delivery.

• 9.2. If packaging is visibly damaged, please note this on the delivery paperwork and take photos.

• 9.3. If you fail to notify us within the stated period, the Products will be deemed accepted.

10. Cancellation and Bespoke Goods

• 10.1. Bespoke Nature of Goods: All our yurts and platforms are bespoke, made-to-order products tailored to specific requirements. Consequently, these Products are exempt from the standard “cooling-off” periods usually applicable to online or distance purchases under consumer protection regulations.

• 10.2. Once the deposit is paid, the Customer is committed to the purchase. There is no right to cancel the Contract or return the goods once manufacturing has commenced or the deposit has been processed.

• 10.3. Returns are not accepted for any reason other than where the goods are proven to be faulty.

11. Returns and Refunds

• 11.1. In the event of a fault, you must notify us in writing immediately.

• 11.2. If a return is agreed upon for faulty goods, they must be returned in the condition they were received.

• 11.3. Refunds (where agreed) will be processed using the original payment method within a reasonable period after inspection.

12. Warranty

• 12.1. We warrant that the Products will be free from material defects for a period of 6 months from delivery, subject to normal use.

• 12.2. This warranty does not cover:

  • Normal wear and tear.

  • Weather damage (extreme winds, snow, storms).

  • Damage from incorrect assembly, neglect, or lack of maintenance.

  • Mould or mildew due to poor ventilation.

• 12.3. If a defect is found, you must notify us promptly with photos and allow us the opportunity to inspect and repair or replace the Product at our discretion.

13. Use, Safety & Maintenance

• 13.1. You must use and maintain the yurt strictly in accordance with our instructions.

• 13.2. It is your responsibility to ensure the yurt is properly anchored and regularly maintained.

• 13.3. In adverse weather, you may need to take additional precautions or temporarily dismantle the yurt.

• 13.4. We are not responsible for accidents or injuries arising from misuse or failure to follow instructions.

14. Limitation of Liability

• 14.1. Nothing excludes liability for death or personal injury caused by our negligence.

• 14.2. Subject to 14.1, we shall not be liable for indirect/consequential loss, loss of profit, or damage arising from your failure to comply with instructions.

• 14.3. Our total aggregate liability shall not exceed the price paid by you for the Products.

15. Force Majeure

• 15.1. We are not liable for delays caused by events beyond our control (acts of God, extreme weather, strikes, etc.).

16. Intellectual Property

• 16.1. All designs, drawings, and content on the Site remain our intellectual property.

17. Governing Law and Jurisdiction

• 17.1. These Terms are governed by the laws of the United Kingdom.

• 17.2. Disputes shall be subject to the jurisdiction of the courts of Chelmsford, UK.
